Claims Manager –Cuxtal II Project

CDMX

Purpose of the Position:

Identify, develop, evaluate, prepare, negotiate, and ensure the timely and correct execution of Claims management strategy for the Project main Contracts: Engineering, Procurement, Construction (EPC), Construction Supervision, Owners Engineer, Supply of Pipe and Turbo-compression equipment for gas transportation assets and services, among others, aligned to the Clients contractual framework and contract(s) specifications to. With an specific focus on risk mitigation.

Responsabilities and Job Functions:

Monitor the day-to-day Contracts communication to identify and follow-up on potential claims related to the execution of Contractual Obligations.

Ensure Formal Communications with Contractors/Suppliers related to Claims are delivered on time, according to the contract notifications procedure and aligned with legal.

Lead Claim Management, in full coordination with the Project Team and Legal team, to:

  • Identify and maintain an updated facts and events traceability matrix,
  • Prepare claims as they arise, requesting additional LDs, cost, or time compensation to contractors/Suppliers.
  • Review and challenge any claims from contractors.
  • Develop the negotiation strategy, documentation and support negotiations of claims.
  • Prepare, update, and finalize any required event claims (e.g., Force Majeure) / change orders / amendments to the offtaker(s), Fully document any material events which may result in formal dispute, as required by the legal team, to ensure Engie’s position.
  • Verify contractors fully comply with Engie’s standards on ethics and anti-corruption.

Regarding contractor/supplier relationships

  • Provision of contractual advice to Project Team (e.g., flow down from TSA) for major subcontracts and suppliers in relation to claims.
  • Ensure all guarantees, insurance policies, bonds, etc are delivered by the Contractor and remain current throughout the project lifecycle.
  • Communicate and raise timely warnings to prevent disputes and claims
  • Support the purchasing team when necessary for subcontracts and supply contracts negotiation.
  • Ensure and follow-up all claims until contract close-out.

 

 

Ocupational Profile:

University degree in Law or Engineering with formal education in law.

plus extensive experience in the construction industry within midstream O&G sector. (Mandatory)

✓  Knowledge of regulatory requirements for the construction and operation of gas transportation projects in Mexico.

  Knowledge of Mexican legislation applicable to contract law (EPCM, O&M and Professional Service agreements).

  Knowledge of Construction phases withing pipeline projects, cost estimating.

✓  Knowledge on instruments required to guarantee delivery, quality, and performance (bonds, insurance policies, Letters of Credit, etc.).

 Ability to evaluate the legitimacy of a claim as well as understand and interpret the main contract provisions by challenging costs, and how these affect scope and schedule.

  Ability to interface with contractors and offtaker(s) on issues ranging from administration of the contract to all matters relating to the review and process of claims, changes, and amendments.

  Knowledge and capacity to draft and prepare court documents related to arbitration or disputes.

  Knowledge of disputes legal procedures, in Mexican and international courts, rules of international arbitration and procedures.

 

15 years of relevant experience in claims management of major contractors in roles dealing with negotiation and management of gas transportation (pipeline) projects, change procedures, cost management, claims and variations, negotiation and settlement of disputes and international arbitrations with contractors and offtaker(s).

 

Ability to write, speak and carry out contractual negotiations in Spanish and English is a must.
